2.  Definitions and Legal Bases

2.1 Definitions

• Data Subject: A natural person whose personal data is processed by us.

• Personal Data: Any information relating to an identified or identifiable natural person.

• Special Categories of Personal Data: This includes data related to union membership, political, religious, or philosophical views or activities, health data, intimate data, ethnic or racial origin, genetic data, biometric data that uniquely identifies a person, criminal and administrative sanctions, and social welfare measures.

• Processing: Any operation performed on personal data, regardless of the tools or methods used, including collecting, recording, storing, altering, disclosing, or deleting.

• European Economic Area (EEA): Includes the EU member states, Liechtenstein, Iceland, and Norway.

2.2 Legal Bases

We process personal data in accordance with Swiss data protection law, specifically the Federal Act on Data Protection (FADP) and its implementing regulations.

Where the GDPR applies, we process personal data based on at least one of the following legal bases:

• Art. 6(1)(b) GDPR: For processing necessary to fulfill a contract with the data subject or to carry out pre-contractual measures.

• Art. 6(1)(f) GDPR: For processing necessary to protect our legitimate interests or those of third parties, provided that the data subject's fundamental rights and interests do not override these. These legitimate interests include the continuous, secure, and reliable operation of our activities, ensuring information security, preventing misuse, enforcing legal claims, and complying with Swiss law.

• Art. 6(1)(c) GDPR: For processing necessary to comply with a legal obligation to which we are subject under applicable EEA law.

• Art. 6(1)(e) GDPR: For processing necessary to perform a task in the public interest.

• Art. 6(1)(a) GDPR: For processing based on the consent of the data subject.

• Art. 6(1)(d) GDPR: For processing necessary to protect the vital interests of the data subject or another natural person.

• Art. 9(2) GDPR: For processing special categories of personal data, particularly based on the data subject’s explicit consent.

The GDPR refers to the processing of personal data as the processing of personal data and the processing of special categories of personal data as the processing of sensitive personal data (Art. 9 GDPR).

3. Nature, Scope, and Purpose of Personal Data Processing

We process personal data necessary to conduct our activities and operations in a sustainable, secure, and reliable manner. The processed personal data may include, but is not limited to, categories such as browser and device data, content data, communication data, metadata, usage data, master data (including inventory and contact data), location data, transaction data, contract data, and payment data.

We also process personal data obtained from third parties, publicly accessible sources, or data collected in the course of our activities, as far as this is permitted by law.

We process personal data, when necessary, with the consent of the data subject. However, we may process personal data without consent in many cases, for example, to comply with legal obligations or to protect overriding interests. We may also ask for consent even when it is not required by law.

We process personal data for as long as it is necessary for the respective purpose. We anonymize or delete personal data, particularly in accordance with statutory retention periods and limitation periods.

4. Disclosure of Personal Data

We may disclose personal data to third parties, have it processed by third parties, or process it jointly with third parties. These third parties are typically specialized service providers whose services we utilize.

6. Job Applications

We process personal data of applicants as far as necessary to assess their suitability for an employment relationship or for the subsequent performance of an employment contract. The required personal data arises particularly from the information requested, for example, in a job posting. We may publish job postings through suitable third parties, such as in electronic and print media or on job portals and job platforms.

We also process personal data voluntarily submitted by applicants, especially as part of cover letters, resumes, other application materials, and online profiles.

Where applicable, we process personal data of applicants in accordance with Art. 9(2)(b) GDPR.

We may allow applicants to enter their details into our talent pool to be considered for future open positions. We may also use this information to maintain contact and provide updates. If we believe an applicant’s details fit an open position, we may inform the applicant accordingly.

We utilize selected services from suitable third parties for electronic recruitment and to facilitate and manage applications. Specifically, we use:

7. Data Security

We take appropriate technical and organizational measures to ensure a level of data security that is appropriate to the respective risk. Our measures ensure, in particular, the confidentiality, availability, traceability, and integrity of processed personal data, although absolute data security cannot be guaranteed.

Access to our website and other online presence is secured using transport encryption (SSL/TLS, specifically with Hypertext Transfer Protocol Secure, abbreviated as HTTPS). Most browsers provide a warning when visiting websites without transport encryption.

Our digital communication is subject to mass surveillance without cause or suspicion by security authorities in Switzerland, the rest of Europe, the United States of America (USA), and other countries. We cannot directly influence the corresponding processing of personal data by intelligence services, police, and other security authorities. We also cannot exclude the possibility that a data subject may be specifically monitored.

8. Personal Data Abroad

We generally process personal data in Switzerland and the European Economic Area (EEA). However, we may export or transfer personal data to other countries, particularly to process or have it processed there.

We may export personal data to any country or territory on Earth, provided that the local law guarantees adequate data protection according to the Swiss Federal Council and, where the GDPR applies, according to the European Commission’s adequacy decision.

We may transfer personal data to countries that do not provide adequate data protection, provided that data protection is ensured by other means, particularly based on standard contractual clauses or other suitable safeguards.

In exceptional cases, we may export personal data to countries without adequate or appropriate data protection if the specific data protection requirements are met, such as the explicit consent of the data subject or a direct connection with the conclusion or performance of a contract. Upon request, we are happy to provide information about any safeguards in place or supply copies of any guarantees.

9.  Rights of Data Subjects

9.1 Data Protection Claims

The supervisory authority for private controllers and federal bodies in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

European data protection supervisory authorities are organized as members of the European Data Protection Board (EDPB). In some European Economic Area (EEA) member states, data protection supervisory authorities are federally structured, particularly in Germany.

10.  Use of the Website

In general, we require your consent to use your email address and other contact details, unless their use is otherwise legally permitted. To obtain double-confirmed consent, we may use the "double opt-in" process. In such cases, you will receive a notification with instructions for double confirmation. We may log collected consents, including IP address and timestamp, for evidence and security purposes.

The respective platform’s terms of service, usage conditions, privacy policies, and other provisions apply. These policies also inform individuals about their rights concerning the platform, such as the right to access their data directly with the respective platform.

13. Third-Party Services

We use specialized third-party services to conduct our activities and operations in a sustainable, user-friendly, secure, and reliable manner. Such services may allow us to embed functionalities and content into our website. These services may technically require the temporary collection of users' IP addresses.

For essential security, statistical, and technical purposes, third parties whose services we use may process data related to our activities in aggregated, anonymized, or pseudonymized forms. This includes performance and usage data to offer the relevant services.

Additionally, we can track whether our ads are successful, such as whether they lead to visits to our website (conversion tracking).

Third parties where we advertise and where you are registered as a user may link the use of our website to your profile on those platforms.

We aim to measure the success and reach of our activities and operations. Based on performance and reach measurement results, we can address issues, enhance popular content, or make improvements.

For performance and reach measurement, we typically collect users’ IP addresses. These IP addresses are usually shortened ("IP masking") to adhere to the principle of data minimization through pseudonymization.

Cookies may be used during performance and reach measurement, and user profiles may be created. These user profiles may include data on individual pages visited, content viewed on our website, screen or browser window size, and approximate location. User profiles are generally created pseudonymously and are not used to identify individual users.
